Long Distance Sales Agreement

 

Parties:
The parties of this agreement are constituted of- on one side: MMC PAZARLAMA (hereafter referred to as MMC PAZARLAMA) located in Ferah Cad. Yeni Şen Sokak No: 4 Çamlıca – Üsküdar/Istanbul address, and on the other side: the Virtual Store Client (hereafter referred to as VSC) of the virtual store’s shoppers or members.

The Beginning of the Agreement
From the time a VSC makes a purchase or uses any services provided is deemed to have committed to comply with this contract for an indefinite period of time.

Obligations of the Parties

• In case any information provided on the registration form or on the order form is not correct or parts of the information are missing, the VSC agrees to compensate for the total of any damages and also agrees on taking full responsibility.
• The VSC agrees that all and any personal comments or ideas shared on the virtual store site belong to them. MMC PAZARLAMA shall never be held responsible for any such comments
• The VSC agrees not to send any messages that are against the rules and morals of the Republic of Turkey.
• The VSC is responsible for any damages that he/she might cause to MMC PAZARLAMA using any threats or abusive language and agrees to compensate for any and all damages.
• The VSC agrees not to advertise or publish any products owned by individuals or institutional parties on the Mutual Use are without the consent of MMC PAZARLAMA.
• MMC PAZARLAMA has the authority of making backups and/or for deleting any data of the files, messages or programs that its members use for services.
• MMC PAZARLAMA has the right to stop its services for any given time or a certain period of time. In case such circumstances should occur, MMC PAZARLAMA is not liable to its special members of any third parties.
• MMC PAZARLAMA does not commit to the timely, secure and error free services and/or service quality measuring to expectations.
• VSC can automatically be directed to other sites wile visiting our virtual store’s site and VSC agrees not to hold MMC PAZARLAMA responsible for any issues that might arise at other sites.
• MMC PAZARLAMA can change item-numbers at any time without any notice. It is not responsible for any issues that might arise due to this process.
• The products sold at the virtual store of MMC PAZARLAMA are limited with their own stocks. MMC PAZARLAMA may not be able to deliver any products that are out of stock, may cancel the entire or part of the order, and may refund the customer the amount that has not been applied to the product.
• MMC PAZARLAMA is the sole owner of properties such as any software, documents, information, graphics that it has created or purchased. The copyright possessions that may arise belong to MMC PAZARLAMA.
• VSC and any registered members’ information that is provided with their own free will and consent with the intention of publicizing on our website such as documents, information, graphics and etc., MMC PAZARLAMA has the sole authority of publishing or moving this information to other addresses. Moreover, MMC PAZARLAMA does not assume any responsibility in case this work is copied by others or they are published on other addresses.
• MMC PAZARLAMA reflects the existing warranty provided by the manufacturer to its VSC. The warrantor of the product(s) is the manufacturing company and not MMC PAZARLAMA. The responsibility of MMC PAZARLAMA is limited and ends by only of providing communication between the manufactured and the VSC.
• Since the VAT amounts vary accordingly, all prices indicated on the website do not include VAT. The VAT is added at the end of purchasing a product. The amount of the VAT is reflected as is to the VSC.
• Unless indicated otherwise, the shipping and handling fees belong to VSC. Unless the VSC indicates otherwise, the shipping is done with the contracted shipping company. The customer accepts the delivery fees agreed between MMC PAZARLAMA and the contracted shipping company.
• All kinds of legal changes occurring outside the scope of the contract arising from the transaction are reflected in the same contract by MMC PAZARLAMA.
• Members and VSCs, in case of any post-conflict situations arising from this contract agree that that the nature of the articles in the contract, in book records and computer records are of binding nature, and would constitute final and exclusive evidence. The VSC duly accepts and swears in advance wavering any copyrights of any of MMC PAZARLAMA records and accepts that they have retained their information and appeal to all kinds in order.
• In cases of conflict arising from the application of this contract authorization shall be executed by the Istanbul Courts and execution offices.
• MMC MARKETING any time unilaterally has the right to terminate this contract.
